Despite votes a...Revised LCP BREF – lost by 0.14%<br /> <br />Despite votes against from Bulgaria, the Czech Republic, Finland, Germany, Hungary, Poland, Romania and Slovakia, the European Commission saw its proposed LCP BREF go through today in the Art. 75 Committee. Greece and the UK supported the new limits. Cyprus or almost any other member state could have tipped the balance. See attached our analysis of the vote which was held under the new, Lisbon Treaty rule, despite a vain attempt by Poland to have this vote, on-an going file, held under the old rule which would have seen it rejected.<br /> <br />New guidelines for legal challenges by NGOs<br /> <br />The Commission used today as an opportunity to publish the attached new guidelines on how national courts, being courts of EU law, must uphold the rights and requirements of NGOs to challenge the implementation of EU law by national authorities, such as the award of environmental permits. NGOs will not have to demonstrate self-endangerment, nor must national courts place a financial burden on NGOs when awarding costs. This sets the scene for many legal battles over the now inevitable derogations that will be given by national authorities in coal-using states.<br /> <br />The European Environmental Bureau (EEB), an NGO financially supported by the European Commission, has already set up a monitoring unit in preparation for legal challenges. It was the first to put out a press release on today’s vote, confirming its close relationship with the Commission. The “death ticker” on the home page of its website reports that the cumulative health costs of delayed implementation of the LCP BREF are today EUR 154,255,269,003.
